Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of Kunjani’s services, including our AI-assisted, game-based learning platform, Microsoft Teams integration, and WhatsApp-based training games (“Services”). By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of an organization, you confirm that you are authorized to accept these Terms on its behalf.

2. Eligibility

You may use the Services only if you:

  • Are at least 18 years old (or the age of majority in your jurisdiction).
  • Have the legal authority to enter into these Terms.
  • Comply with all applicable laws and regulations.

3. Accounts and Access

  • Customers are responsible for maintaining the confidentiality of account credentials.
  • You must notify Kunjani immediately if you become aware of unauthorized access or use of your account.
  • Access rights may not be shared outside of your organization unless explicitly permitted by Kunjani.

4. Use of Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:

  • Attempt to gain unauthorized access to our systems or data.
  • Misuse the Services to distribute malicious code, spam, or unlawful content.
  • Reverse engineer or attempt to extract source code except as permitted by law.
  • Use the Services in a way that infringes intellectual property rights.

Kunjani reserves the right to suspend or terminate accounts that violate these terms.

5. Customer Data

  • You retain all rights to the data you provide (“Customer Data”).
  • By using the Services, you grant Kunjani a limited license to process Customer Data solely for the purpose of delivering the Services.
  • Kunjani will protect Customer Data in line with its Privacy Policy.

6. Sub-Processors and Third Parties

To deliver the Services, Kunjani relies on trusted sub-processors, including Microsoft Azure, WhatsApp Business API providers, OpenAI, and Google Cloud (Gemini). Sub-processors are bound by contractual obligations to protect your data. A full list of sub-processors is available in our Privacy Policy.

7. Service Availability

We strive to keep the Services available and reliable. However:

  • Services may be interrupted for maintenance, upgrades, or unforeseen outages.
  • Kunjani does not guarantee 100% uptime but will take reasonable steps to minimize downtime.

8. Intellectual Property

  • All intellectual property rights in the Services, including software, content, and branding, remain with Kunjani or its licensors.
  • Customers may not use Kunjani’s branding or trademarks without prior written consent.

9. Fees and Payment

If you purchase paid Services:

  • Fees are specified in your order or contract.
  • Payments must be made in accordance with the agreed billing schedule.
  • Late payments may result in suspension of Services.

10. Termination

You may terminate your use of the Services at any time by providing written notice.
Kunjani may suspend or terminate Services if you breach these Terms or fail to pay fees.
Upon termination:

  • Access to the Services will cease.
  • Customer Data will be retained for up to 30 days, after which it will be deleted in line with our Privacy Policy.

11. Disclaimers and Limitation of Liability

  • The Services are provided “as is” without warranties of any kind, whether express or implied.
  • To the maximum extent permitted by law, Kunjani is not liable for indirect, incidental, or consequential damages.
  • Kunjani’s total liability under these Terms will not exceed the amount paid by the customer for the Services in the 12 months preceding the claim.

12. Changes to Terms

We may update these Terms from time to time. Updated Terms will be posted on our website, and material changes will be communicated to customers. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales.
Any disputes will be subject to the exclusive jurisdiction of the courts of London, United Kingdom.
